The State of West Bengal In pursuance of the direction passed by this Court earlier on 2nd April, 2024 a report is submitted by the Officer-in-Charge, Saltora Police Station stating that the appellant Tapan Nayak had expired four years ago as reflected from a certificate issued by the Pradhan, Pabra Gram Panchayat, which is tagged with the report.

AS the sole appellant has already expired, so the instant appeal stands abated.

The instant appeal be and the same is dismissed as abated. The appeal being CRA 138 of 1994 is disposed of. Let a copy of this order along with the Trial Court Records be sent down to the Trial Court at once.
