Mukul Sarkar v. State Of West Bengal
24.2.2022 sb CRR 786 of 2020 (Via video conference) In Re: An application under Section 401 read with Section 482 of the Code of Criminal Procedure, 1973.
In the matter of : Mukul Sarkar .......Petitioner Mr. Anindya Ghosh .......for the Petitioner Mr. Anwar Hossain Ms. Sreyashee Biswas ...for the State Report so submitted by the learned advocate for the State, be kept with the record.
The petitioner preferred this revisional application at a stage when the Chemical Examiner's report was not available. Pursuant to the earlier order dated 22.2.2022 passed by this Court, Mr. Hossain, learned advocate for the State has submitted a report which reflects that already Chemical Examiner's report has been submitted.
Learned advocate for the petitioner submits that in course of time, charge has already been framed and the next date has been fixed on 22nd March, 2022 for evidence.
In view of the fact that the petitioner is in custody since August 2019 and the courts had to operate in a staggered manner for a considerable period of time in the year 2020 and 2021, I am of the opinion that no time schedule can be fixed for concluding the trial. However, the learned special Court would at least afford opportunity in the instant case fixing three continuous dates in a
period of each and every 45 days so that the trial can be taken to its logical conclusion.
With the aforesaid observations, the revisional application being CRR 786 of 2020 is disposed of.
All parties are to act on the server copy of this order, duly obtained from the official website of this Court. (Tirthankar Ghosh, J.)
