Petitioner complains that inspite of he being the owner of the land and intends to raise construction, the private respondents are unnecessarily interfering with the enjoyment of his property.

Learned advocate for the State has submitted a report. Report reflects that the police authorities have already drawn up proceedings under Section 126 of the BNSS on or about 14.03.2025.

So far as the right, title and interest of the property is concerned, the Civil Court is the appropriate forum for ventilating the grievance. Police authorities have been keeping a strict vigil as is reflected from the report. They would continue to keep a strict vigil and ensure there is no breach of the peace and/or tranquility and/or any untoward incidents resulting from the strained relationship existing between the parties.

With the aforesaid observations WPA 5512 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
