08.04.2025 SB C.R.M. (NDPS) 296 of 2025 In Re:- An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection Airport Police Station Case No. 151 of 2020 dated 16.09.2020 under Sections 20(b)(ii)(c)/28/29 of the NDPS Act, 1985 (N-64 of 2020).
In the matter of : Hasnur Mondal @ Hasanur Mondal .... Petitioner Mr. Debasis Kar Mr. Husen Mustafi ...for the Petitioner Mr. Antarikshya Basu Ms. Madhumita Basak ...for the State Report submitted by the State is taken on record. Learned counsel for the petitioner submits that nothing was recovered from his possession and he is in custody since 2nd February, 2025. He further submits that the prosecution during investigation, also could not establish that he had any role in money transaction. He further submits that the other co-accused persons are already on bail and as such, he is entitled to be released on bail.
Learned counsel for the State raised strong objection and he referred the contents of the charge sheet in the context of Section 27A of the NDPS Act, 1985. He further submits that the case was registered in the year 2020 and the accused/petitioner was absconding since then and on the strength of warrant of arrest only he could be arrested in the month of February, 2025. He further submits that out of eight witnesses, three witnesses have already been examined and
the examination of rest of the prosecution witnesses will be completed within next six months.
Having heard learned counsel appearing on behalf of both the parties, it appears that in the charge sheet, petitioner's involvement has been specifically stated and as such there are sufficient grounds for believing that the accused has involvement with the alleged offence and as such regour of section 37 attracts in the present case. In view of the aforesaid facts and circumstances of the case and the materials so far available in the case diary, I find that this is not a fit case where the petitioner may be enlarged on bail, thus bail prayer made by the petitioner is considered and rejected.
In such view of the matter, CRM (NDPS) 296 of 2025 stands dismissed.
