C.R.M. (NDPS) 295 of 2025 In Re:- An application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with NDPS Case No. 46 of 2024 arising out of Baishnabnagar Police Station Case No. 561/2024 dated 20.06.2024 under section 21(c)/29 of the NDPS Act, 1985.

It is submitted on behalf of the petitioner that the petitioner is in custody for about 363 days and about 420 gms. of brown sugar was allegedly recovered from the possession of the petitioner. He further submits that though investigation culminated into charge-sheet but charge has not yet been framed and as such, nobody knows when the trial would be concluded and for which he prayed for bail on any terms and conditions. Learned counsel appearing on behalf of the State opposed the bail prayer of the petitioner and contended that 420 gms. of brown sugar was recovered from the exclusive possession of the present petitioner and that the prosecution has received the forensic report, which confirms that the recovery substance is a narcotic substance.

Having considered the submissions made on behalf of both the parties and also on perusal of the

materials placed before this court, I find that the rigour of Section 37 of the NDPS Act clearly attracts in the present case in respect of the present petitioner and as such, the prayer for bail made by the petitioner, is rejected.

However, the Trial court is requested to make every endeavour for expeditious disposal of the proceeding. CRM (NDPS) 295 of 2025 is accordingly disposed of.
