I have perused the allegations made in the petition of complaint and stage at which the petitioner has approached this Court.
Having regard to the fact that the petitioner approached this Court immediately after issuance of process, I am of the opinion that an opportunity must be given to the complainant to adduce this evidence before charge. The petitioner will be at liberty to attach the points canvassed in the revisional application at the stage for consideration of charge before the learned Magistrate. No interference is called for at this stage.
Accordingly, CRR 803 of 2020 is dismissed.
All pending connected applications, if any, are consequently disposed of.
Interim order, if any, is hereby vacated.
