Petitioner Mr. Koustav Bagchi ... for the petitioner The learned Advocate for the petitioner submits that although the petitioner is in custody for about 656 days but there has been no progress in the case being Case No. N-36 of 2019 pending before the learned Special Court under NDPS Act, Barrackpore. The learned Advocate further submits that the prosecution has relied upon eight witnesses in the charge-sheet and all the witnesses belong to the police department. Mr. Arijit Ganguly, learned Advocate is directed to appear on behalf of the State.

In view of the fact that the petitioner is in custody for about 656 days, I direct that the learned trial court should fix schedule of the case at least once in a month so that there can be smooth progress of the trial. The learned trial court should take all efforts to see that all the materials, particularly, material exhibits which are to be relied upon by the prosecution are produced on the date so fixed, to that extent the office of the learned trial court would communicate with the Public Prosecutor who would take necessary steps in ensuring the presence of the witnesses all of whom belong to the police department.

It is further directed that the learned trial court would take

all necessary efforts so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. With the aforesaid observations, CRR 806 of 2020 is disposed of (Tirthankar Ghosh, J.)
