ct. no. 34 CRR 807 of 2020 Murari Sardar @ Murari Mohan Sardar Vs.

State of West Bengal & Ors.

The revisional application has been preferred challenging the order dated 13.1.2020 passed by the Learned Additional Sessions Judge, at Diamond Harbour, South 24 Parganas, being Criminal Motion Case No.05 of 2020.

The genesis of the revisional application relates to an order dated December 30, 2019 passed by the Learned SubDivisional Magistrate, Diamond Harbour in connection with M.P. Case no.2987 of 2019.

Having regard to the time frame prescribed under the provisions of Section 144(2) of the Code of Criminal procedure, I am of the opinion that by efflux of time such order has become infructuous. Consequently, M.P. Case No.2987 of 2019 is quashed. As such, the interim order passed on 31.1.2010 by the Learned Additional Sessions Judge Diamond Harbour is deemed to be infructuous.

The present revisional application being CRR 807 of 2020 is disposed of as infructuous.

All pending connected applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. ( Tirthankar Ghosh, J.)
