Affidavit-of-service filed on behalf of the petitioner is taken on record.

Matter is heard in presence of the learned advocates representing the petitioner and State respondents.

A report is filed which is prepared by Inspector-inCharge, Shibpur Police Station, Howrah dated 5th March, 2026 and same is taken on record.

On perusal of the report, it appears that based on written complaint FIR was lodged and Shibpur P.S. Case No. 85/26 dated 22nd February, 2026 was initiated under Sections 126(2) /115(2) /117)(2) / 74 /329(3) /303(2) /323 /324(4) /351(2) /3(5) of Bhatatiya Nyaya Sanhita (BNS), 2023.

It is further disclosed in the report that investigating officer arrested four accused persons but two others, namely, Vicky Yadav and Badri Narayan Yadav fled away. Subsequently, on 20th

February, 2026 Vicky Yadav and family members of petitioner were cautioned and were directed to maintain peace.

It transpires from the submission made on behalf of the petitioner that a civil suit was decreed in favour of the petitioner and an appeal was preferred which was disposed of. The suit was concerning boundary wall of the house of the petitioner.

If the order of the civil court is not complied with, leave is granted to the petitioner to take steps in accordance with law.

However, from the report filed today on behalf of the concerned police authority dated 5th March, 2026, it appears that certain steps have been taken against accused persons in connection with Shibpur P.S. Case No. 85/26 dated 22nd February, 2026.

Therefore, this Court finds there is no need to keep this writ petition pending and the same stands disposed of with the direction upon the concerned police authority of Shibpur Police Station to maintain peace and tranquility at the place in question where house of the petitioner situates.

10. Copy of the report dated 5th March, 2026 is made over to the learned advocate representing the

petitioner.

11. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
