ct. no. 34 (via video conference) CRR 815 of 2020 + IA No. CRAN 1 of 2021 IA No. CRAN 2 of 2021 Smt. Rupashree @ Rupasree Mukherjee Vs.

The State of West Bengal & Anr.

Mr. Amitabha Ghosh .....for the Petitioner.

Mr. Madhusudan Sur, Mr. Dipandar Paramanick, .....for the State.

Mr. Somnath Gangopadhyay, Mr. Rahul Singh, ... for the O.P., Report submitted by Mr. Sur, learned advocate appearing on behalf of the State, prepared by the Joint Commissioner of Police(Crime), Barrackpore Police Commissionerate be kept with the record.

The contents of the report reflect that after further investigation thoroughly being conducted, no evidence could be detected against the present petitioner being Smt. Rupashree @ Rupasree Mukherjee as such, the investigation authorities filed a final report with the prayer for discharge before the jurisdictional Court. It would be for the jurisdictional court to consider the prayer advanced by the Investigating Agency.

As the revisional application was filed before this court with the prayer for quashing of the charge-sheet, I am of the opinion that as presently no charge-sheet exists before a court of law, the revisional application has become infructuous. However, the jurisdictional court which is in seisin of the matter after filing of the final report will pass an order after affording opportunities to all the parties.

Accordingly, CRR 815 of 2020 is disposed of.

All pending connected applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. ( Tirthankar Ghosh, J.)
