Learned advocate appearing for the petitioner submits that, there was a free fight amongst the family members. One of the accused was granted anticipatory bail by the Sessions Court. Learned advocate appearing for the State draws the attention of the Court to the statement of the victim recorded under Section 164 of the Code of Criminal Procedure (Cr.P.C.). There is an allegation of outraging the modesty of a lady as against the petitioner. The 161 Cr.P.C. statement of the lady implicate the petitioner in the offence.

Considering the gravity of the offence and the involvement of the petitioner therein, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 1359 of 2022 is dismissed.
