Learned counsel appearing on behalf of the petitioner submits as follows. The de facto complainant and his associates wanted to purchase some land. It is alleged that a person impersonated the owner of the land and took money from them. Seven cheques were encashed, but the property was never delivered. The petitioner has been falsely implicated in this case. He was never a beneficiary of the transaction. The money that came into his account was immediately transferred. The petitioner stands on a different footing than Md. Motasim Billah @ Rintu, whose anticipatory bail application was rejected by this Court.
Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He submits that the petitioner is a fraudster. He stands on the same footing as the one whose anticipatory bail application was earlier rejected by this Court. While the said other co-accused received a sum of Rs.11.5Lakhs, the present petitioner received a sum of Rs.10Lakhs in his account. He
thereafter transferred the sum to the bank of one Khairul. The statement of the witness Khairul, implicates the present petitioner. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail to the present petitioner. The application for anticipatory bail of the petitioner is, thus, rejected.
