Rakib (Rejected) CRM (M) 644 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Nandigram Police Station case no. 667 of 2024 dated 27.07.2024 under Sections 64(2)(m)/65(1)/140(3) of Bharatiya Nyaya Sanhita, 2023 and 6(1) of the POCSO Amendment Act.

Learned advocate appearing for the petitioner submits that petitioner is in custody for one year nine months and till date trial has not been concluded, as such, petitioner may be released on bail on any stringent conditions.

Learned advocate appearing for the State on the other hand submits that out of 11 witnesses 9 witnesses have already been examined.

Having regard to the advance stage of the case, I am not inclined to release the petitioner on bail.

However, the learned trial Court would ensure that within 75 days from the next date fixed the evidence of all the prosecution witnesses be completed and thereafter within a period of 45 days if the defence do not tender any witness pronounce the verdict of the case.

In view of the observations made above CRM (M) 644 of 2026 is dismissed.
