Learned advocate for the petitioner has challenged the order dated 24th January, 2023 passed in Criminal Revisional No. 07 of 2022.

The subject matter relates to the order dated 13-05-2022 passed in complaint case no. 06 of 2016 in a proceeding under Section 138 of the N. I. Act.

Having regard to the contentions so advanced as also the point of grievance expressed by the petitioner, I am of the view that the same relates to the questions which have been considered by the learned Magistrate as well as the learned session court. No fresh question of law has been framed for consideration before this court. So far as the issue relating to other points are concerned, the same relates to facts. Petitioner would be at liberty to canvass the same at the appropriate stage of the trial including the final argument of complaint case no. 06 of 2016.

With the above observations, the present revisional

application being CRR 804 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
