...........Amicus Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is not the principal accused. Out of 14 accused named in the FIR, charge sheet was submitted only against
6. There was a dispute that took place in connection with a marriage ceremony, but the issue was finally resolved. Learned Amicus assisting the State relies on the case diary and opposes the prayer for anticipatory bail. The prosecution case is that the petitioner and the other accused stopped the car carrying the bride and groom and the marriage party and demanded money. When they refused to pay up, the petitioners assaulted them with hansua, sticks and iron rods. Three persons received injuries, some of them serious inflicted on the head requiring stitches for repair. Proclamation has already been issued against the petitioner. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail to the present petitioner.
The application for anticipatory bail of the petitioner is, thus, rejected.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
