The petitioner is a mother who is aggrieved of being thrown out of the property by the respondent no.5. It has been alleged that the respondent no.5 also got the job of his father on compassionate appointment. The respondent no.5 did not look after his mother and in fact has thrown out her from her possession as is alleged by the petitioner which is the cause of grievance for approaching this Court after informing the police authorities. Learned advocate appearing for the State submits that subsequently on the basis of the complaint, Chakdah P.S. Case No. 270 of 2024 dated 09.03.2024 was registered for investigation. In view of the nature of accusations relating to maintenance and accommodation, I am of the

view that since substantial time has passed from the date on which representation was made to the police authorities, it would be fit and proper in the circumstances to approach the Sub-Divisional Officer or the appropriate authority under the provisions of Maintenance and Welfare of Parents and Senior Citizens Act, 2007. The concerned authority would assess regarding the issues which are canvassed relating to maintenance as well as residential accommodation of the petitioner and pass necessary directions. In order to implement such order, if the appropriate authority is of the opinion that police assistance is required, necessary directions be passed upon the police authorities to implement such order.

With the aforesaid observations, the writ petition being WPA 5574 of 2024 is disposed of. There will be no order as to costs.
