Petitioners are aggrieved by the police authorities, as the private respondents had been resisting from carrying out the operations of the tea garden. Such information was furnished on or about 22.04.2023 before the Officer-in-Charge, Chopra Police Station, District - Uttar Dinajpur.

A report has been submitted by the Inspector-inCharge, Chopra Police Station which reflects that series of cases have been registered from 14.04.2023 till 22.08.2023. Petitioners submit that there is an order of the civil court also.

Be that as it may, the police report reflects that there was a major clash in the tea garden between the tribals who were residing in the temporary shed of the tea garden and the buyers of the tea garden.

Having considered the facts in the report, I direct the Superintendent of Police, Uttar Dinajpur that if a representation is furnished by the petitioners expressing their grievance and with a prayer for police picket in such

circumstances, the Superintendent of Police will exercise the discretion of his office after assessing the ground situation prevailing at the cost of the petitioners. With the aforementioned observations, the instant writ petition being WPA 5579 of 2024 is hereby disposed of.

Report submitted be kept with the record.

Copy of the report be handed over to the learned Advocate appearing for the petitioner.

Parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
