Petitioner is aggrieved by the fact that the present case under Section 138 of the Negotiable Instruments Act was initiated in the year 2017 being A.C. Case No.966 of 2017 and is pending before the learned Judicial Magistrate, 5th Court, Alipore. Learned advocate submits that till date the evidence has not commenced and only the examination under Section 251 of the Code of Criminal Procedure is over.

Having considered the submissions made on behalf of the petitioner regarding the progress of the case, I direct the learned trial court to fix at least one date in a month so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. Let the prosecution evidence be over by 30th June, 2024. The examination under Section 313 of the Code of Criminal Procedure be completed by 15th August, 2024. The defence evidence be concluded by 30th November, 2024 and the judgment be delivered by the learned trial court by 31st December, 2024. With the aforesaid observations, CRR 855 of 2024 is

disposed of.

Pending connected application, if any, is consequently disposed of.
