Kausik (Rejected) CRM (NDPS) 431 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Narcotics Control Bureau, Kolkata Zonal Unit, NCB Crime No. 17/2025 under Section 20(b)(ii)(c)/29 of the NDPS Act, 1985. Learned advocate appearing for the petitioner submits that petitioner is in custody for 240 days and out of the total recovery of 94 Kgs. of Ganja from the possession of the petitioner, 19 Kgs. of Ganja were allegedly recovered. Learned advocate has referred to the earlier order. However, having regard to the fact that only charge sheet has been submitted, presently, I am not inclined to release the petitioner on bail at this stage as the rigors of Section 37 of the NDPS Act is attracted.

Petitioner would renew his prayer for bail after the evidence of the seizure list witnesses are over. To that effect, I

direct that immediately after the stage of consideration of charges are over, the learned Trial Court within a period of 60 days thereafter, would complete the evidence of the seizure list witnesses.

With the aforesaid directions the bail application being CRM (NDPS) 431 of 2026 is rejected at this stage. Report submitted by the NCB be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
