Mr. Rishav Singh Mr. Soumalya Dutta ...for the Petitioner In this application, the petitioner has prayed for direction upon the court below for expeditious disposal of the complaint case no. 2246 of 2022 under Section 141 read with Section 138 of the N.I. Act., presently pending before the learned Judicial Magistrate, 8th Court, Alipore. Being aggrieved by the aforesaid proceeding, learned counsel for the petitioner submits that the complaint was filed on 17th August, 2022 and the accused person appeared before the court below on 19.10.2022. But since then, the case is pending for plea hearing. Therefore, the petitioner has prayed for appropriate direction upon the court below for expeditious disposal of the aforesaid proceeding.

Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice and as such, the service of copy of application upon the opposite parties is hereby dispensed with.

Having considered the long pendency of the proceeding and that the statute mandates under Section 143 of the N.I. Act for disposal of such proceeding within a time limit, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. I am told that the next date is fixed on 12.5.2026 for plea hearing.

In such view of the matter, the instant application being CRR 1056 of 2026 is hereby disposed of with a direction upon the court below to make every endeavour to conclude the plea hearing on the next date i.e. on 12.5.2026 or preferably within a month thereafter without granting any unnecessary adjournment to either of the parties.

This order is passed invoking this court's jurisdiction under Section 529 of the BNSS.
