Petitioners have challenged the proceedings arising out of Mahishadal P. S. Case No. 136 of 2023 dated 05-03-2023. Record reflects that chargesheet has already been submitted before the jurisdictional court on or about 22nd August, 2023. In the list of witnesses in the report under Section 173 of the Code of Criminal Procedure, I find that the complainant along with others and a doctor also happens to be a witness.

The documents under Section 207 of the Code of Criminal Procedure have not been enclosed along with the revisional application. Accordingly, I direct the learned Magistrate to consider all the issues canvassed in the present revisional application at the stage of consideration of charges.

If the petitioners take out an application under Section 239 Cr.PC, learned Magistrate will consider the same in accordance with law without being influenced by any observations made by this court while disposing of the revisional application.

With the above observations, the present revisional application being CRR 910 of 2024 is disposed of. Pending applications, if any, are consequently disposed of.
