Counsel for the petitioners submit that the FIR has been registered inter alia under Section 498A/302 IPC. It has subsequently transpired that in course of investigation the victim had committed suicide.

It is submitted by the counsel for the petitioners that the husband has already obtained bail and the petitioners being the mother-in-law and brother-in-law of the victim need not be detained in custody any further. It is also submitted that the charge-sheet has already been filed in the case. Counsel for the State submits that the victim was tortured inter alia by denial of food by the petitioners and the victim appears to have been forced to commit suicide. In the above circumstances and considering the case diary and the evidence on record, this Court is not inclined to grant anticipatory bail to the petitioners under Section 438 CrPC and hence dismissed.
