Petitioner is aggrieved by the factum that the application under Section 23 of the PWDV Act for interim monetary relief is pending before the learned Judicial Magistrate, 3rd Court, Howrah. I find that the present case under Section 12 of the PWDV Act was filed in the year 2023. The parties are yet to complete their exchange of affidavit of assets and liabilities as well as written objection.

Learned Magistrate, 3rd Court, Howrah is directed to ensure that the said process is completed within a period of three months from date. Learned Judicial Magistrate would dispose of the application under Section 23 of the PWDV Act by 31st July, 2024. Thereafter the learned trial court would fix one date in every 45 days for the purpose of trial of the case to conclude the trial at the earliest.

With the aforesaid observations, CRR 863 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
