The petitioner is aggrieved by the fact that in spite of information furnished with the police authorities in respect of the injury suffered by the petitioner and his family members, no case was registered by the police authorities. On the other hand, the police authorities were pursuing the cause of the private respondents who were responsible for inflicting injury upon the petitioner and his family members.
State has submitted a report which reflects that on the basis of complaint of the petitioner, Minakhan P.S. Case No. 70/2025 dated 14.02.2025 was registered for investigation and one of the accused persons was arrested in connection with the said case while on the basis of written complaint of one Selima Bibi, Minakhan P.S. Case
No. 71/2025 dated 14.02.2025 was also registered for investigation.
Prima facie, on the basis of the accusations as also the report submitted, it reflects that both the parties are at loggerhead and as such, the police authorities had to initiate case and countercase. The petitioner also submitted a representation to the Superintendent of Police, North 24-Parganas. Having regard to the fact that the petitioner and the private respondents are at loggerhead and there are injuries which reflect that both the parties are aggressive, the Superintendent of Police will direct the Officer-in-Charge, Minakhan Police Station to ensure that none of the parties are allowed to take law and order in their own hands and to that effect, if required, the police authorities will pray before the jurisdictional court concerned in connection with both the cases being Minakhan P.S. Case No. 70/2025 dated 14.02.2025 and Minakhan P.S.
Case No. 71/2025 dated 14.02.2025 that any of the accused persons who is trying to take law in his own hand, would stay outside the jurisdiction of Minakhan Police Station.
The Officer-in-Charge, Minakhan Police Station would ensure that no breach of the peace or tranquility takes place at the locale and/or any untoward incident results because of the inimical
relationship existing between the petitioner and the private respondents.
With the aforesaid observations, the writ petition being WPA 5234 of 2025 is disposed of. There will be no order as to costs.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
