Petitioners are aggrieved with the order dated 10th December, 2025 passed in GR Case No. 2593 of 2024 by which the court below had issued warrant of arrest against all the petitioners with the observation that ample opportunities were given to them to appear but they failed to comply the order of learned court.

Being aggrieved by the aforesaid order learned counsel for the petitioners makes an innocuous prayer that liberty may be given to the petitioners so that they may surrender before the trial court.

Having heard learned counsel for the petitioners it appears that if any order is passed in terms of the prayer made in the petition, the opposite party will have no cause to prejudice and as such, service of copy of application upon the opposite party is dispensed with.

Since the prayer made on behalf of the petitioners is justified, the instant application being CRR 1070 of 2026 is hereby disposed of giving liberty to the petitioners to surrender

before the court below within a period of two weeks and in the event of such surrender by the petitioners, the court below will dispose of their prayer in accordance with law, without being influenced by any observation made herein.

The impugned order dated 10th December, 2025 by which the warrant of arrest was issued against all the accused persons is hereby stayed for a period of two weeks from date or till the petitioners surrender before the court below whichever is earlier. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
