Petitioner is aggrieved by the progress of the investigation relating to Habra PS Case No. 41/2025 dated 31.01.2025. It has been submitted neither the documents have been seized nor the police authorities have put in efforts for progressing with the investigation of the case.

State has submitted a report. Report reflects that after registration of the case, the concerned Registrar was examined. Statement has been recorded and there is a report of the concerned ADSR. The report of the ADSR substantiates the contention regarding non-existence of the title deed referred to by the petitioner.

Learned advocate for the private respondent disputes and denies the contentions and submits that they have been victimized.

I have considered the plight of the petitioner and I am of the view that the investigation of the case is in progress. Police authorities are putting in their efforts. They are directed to take further endeavour so that the investigation of the case is taken to its logical conclusion by collecting effective materials.

Petitioner also contends that the witnesses are being threatened. In case such insecurity is felt by the petitioner who has set the law into motion an application be filed before the jurisdictional court under the relevant provisions of Witness Protection Scheme, 2018, learned Magistrate will call for a threat perception report and pass necessary directions under the scheme referred to above. With the aforesaid observations WPA 5306 of 2025 is disposed of.

Report so submitted be kept with the record.

A copy of the report without any enclosures be handed over to the learned advocate appearing for the petitioner.
