Learned counsel for the petitioner contends that despite having applied for a new electricity connection as long back as on August 17, 2018, the CESC Limited did not take any step thereon.

Thereafter, on January 15, 2020, a representation was made by the petitioner to that end, without, however, any result.

Learned counsel appearing for the CESC Limited hands over a copy of a purported communication made by the CESC Limited to the petitioner on July 17, 2018, whereby it was communicated that the CESC Limited apprehends splitting of load in the event the connection is given to the petitioner.

Be that as it may, due to pendency of the present writ petition, it cannot be said strictly that the petitioner

is out of time in challenging the said observation of the CESC Limited.

However, since the concerned Grievance Redressal Officer (GRO) is the appropriate authority in law to decide such issues, WPA 4172 of 2020 is disposed of by granting liberty to the petitioner to file an appropriate complaint with regard to the issue raised in the writ petition within a week from date.

If so filed, the said GRO shall decide the issue in accordance with law upon giving opportunity of hearing to all concerned, deeming that the limitation period for filing the said complaint starts from today.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
