The petitioner contends that he is the owner of the property since 2022. That connection had been granted to the respondent no.5, who was a complete stranger to the property.

The learned advocate for the West Bengal State Electricity Distribution Company submits that the respondent no.5 was given connection upon compliance of all formalities. That the said connection was granted sometime in 1991 and the respondent no.5 has been regularly paying the bills. The petitioner had become the owner in 2022. The pre-existing supply line cannot be disconnected on the petitioner's prayer on the allegation that the respondent no.5 is a stranger to the property. The West Bengal State Electricity Distribution Company is not required to adjudicate the right of the respondent no.5 to remain in the property.

Admittedly, the disconnection cannot be effected except in accordance with law. The dispute between the petitioner and the respondent No.5 is a private dispute. However, as the petitioner has raised an objection, the Station Manager, West Bengal State Electricity Distribution Company, Laxmikantapur Customer Care Centre shall intimate the petitioner why his prayer cannot be accepted, with adequate reasons. Such communication will reach the petitioner within two months.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
