Petitioner approached this Court for quashing of the proceedings arising out of Baguihati Police Station Case No.18 of 2008 wherein charge-sheet was submitted in the year 2009. Records reflect that in a designed manner the accused persons were evading the court.

Petitioner intends to submit that he being a Central Government employee has been falsely implicated in connection with the instant case.

Having regard to time period which lapsed since initiation of the proceedings and cognizance being taken, I am not inclined to interfere at this belated stage. Learned Magistrate on and from the next date would ensure that proclamation is issued against all the accused persons who are absconding in court, thereafter on the expiry of the statutory period, Section 83 of Cr.P.C. be invoked. If required, the case be split up after exhausting the process and steps be taken for consideration of charges. The whole of the process may be concluded within six months of the next date so fixed.

With the aforesaid observations, CRR 867 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
