The Report filed by the State be kept with the records. It appears from the said Report that the State respondents have conducted that the private respondent has illegally and unauthorisedly constructed at the subject premises. It is further submitted on behalf of the State respondents that the Sub-Divisional Officer (SDO) has been directed to take further action in accordance with law.

In view of the submissions made on behalf of the State, WPA 5558 of 2024 stands disposed of by directing concerned SDO to take an informed decision in accordance with law within a period of two weeks from the date of

communication of this order to the said respondent and after giving a right of hearing to all the affected parties including the petitioner, in accordance with law and without being influenced by any observation made in this order.

Since no affidavits have been called for, the allegations contained in the writ petition are deemed to have not been admitted by the respondents.

There shall be no order as to costs.
