REJECTED C.R.M.(A) 851 of 2025 In Re:- An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Mogra Police Station Case No. 11 of 2025 dated 09.01.2025 under Sections 336(2)/336(3)/340(2) of the B.N.S., 2023.

And In Re : Sk. Chandu ...... petitioner Mr. Bitasok Banerjee Mr. A. Salam .....for the petitioner Ms. Zareen Nasima Khan Mr. Sobhan Gani .... For the State A dumper was seized. On seizure, it transpired that the chassis number of the dumper does not exist or at least does not match with the number of the maker. Petitioner before us is the owner of such dumper.

Enlarging the petitioner on anticipatory bail will send a wrong signal to the society. Petitioner was running such dumper on the road. In the event of an accident, the persons suffering any injury caused by the dumper will be without any insurance coverage.

In such circumstances, we are not inclined to grant anticipatory bail to the petitioner and the prayer for anticipatory bail is rejected.

Accordingly, C.R.M. (A) 851 of 2025 is dismissed. (Debangsu Basak, J.) (Smita Das De, J.)
