The Panchayat is not represented despite service. The petitioner alleges that Akna Gram Panchayat has constructed a road by encroaching upon the land of the petitioner. The petitioner submitted a written objection to the same before the Panchayat on 13th October, 2025. In reply to the said objection, the Panchayat by a letter issued on 23rd October, 2025 admitted the allegation of the petitioner. The letter records that the Panchayat has constructed a road through the petitioner's land without consent of the petitioner. The member of the Panchayat recorded an assurance that the said road would be removed and the petitioner's property would be surrounded by a kachha boundary structure.

Learned counsel for the petitioner submits that the Panchayat has not acted in terms of the said letter till date.

Learned counsel for the private respondents submits that they have no role to play in the present matter.

Learned counsel for the State points out that the letter dated 23rd October, 2025 has not been signed by the Pradhan.

It appears that the letter dated 23rd October, 2025 issued in response to the complaint made by the petitioner on 13th October, 2025 has been signed by a member of the Panchayat and not the Pradhan.

However, in view of the assurance given in the letter, the Pradhan, Akna Gram Panchayat, being the 5th respondent herein, is directed to consider the grievance of the petitioner and take necessary steps in terms of the letter issued on 23rd October, 2025 within four weeks from the date of communication of this order.

The writ petition is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
