The petitioner alleges inaction on the part of the Pradhan of Bikrampur Gram Panchayat. It is the specific case of the petitioner that the said authority has not processed his application seeking permission to raise a construction.

It does not appear from the records that any application in the prescribed form with the requisite fee was ever deposited in the office of the gram panchayat. Under such circumstances, no order can be passed in the writ petition. If the petitioner applies in the prescribed form with the prescribed fees and fulfills all the eligibility criteria, the application shall be processed. However, before any permission is granted, the authority shall ensure that there are no objections from the cosharers in respect of the plot in question. Other criteria,

which are required to be fulfilled as per the building rules and the West Bengal Panchayat Act, 1973, shall also be verified and checked.

The writ petition is, thus, disposed of.

There shall be no order as to costs.

Parties are to act on the basis of the server copy of this order.
