Written instructions submitted on behalf of the State-respondents is taken on record.

The petitioner applied for grant of inter-state route permit from Galgaliya (West Bengal) to Purnia (Bihar) on October 29, 2022 and submitted a representation before the concerned authority on February 02, 2023 requesting consideration of his application and grant permit in his favour. The representation is yet to be considered. It is submitted on behalf of the State-respondents that 9 vacancies in the route applied for by the petitioner have been filled up. The application submitted by the petitioner could not be considered since the same is bereft of the area or route for which permit was sought. Be that as it may, since the representation submitted by the petitioner before the concerned authority

is pending, the writ petition is disposed of directing the concerned authority, being the 3rd respondent herein, to consider and dispose of the representation submitted by the petitioner within a period of six weeks from the date of communication of this order after giving reasonable opportunity of hearing to all the stakeholders including the petitioner, in accordance with law.

With the above observations and directions the writ petition is disposed of.

There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
