No notice is required to be served upon the opposite party. Thus, service of notice is dispensed with.

From the record it appears that on behalf of the defendants one application has been filed with a prayer for vacating the order of ex parte hearing and not only that on behalf of the plaintiff one objection to that petition for vacating the order of ex parte hearing was filed.

Unfortunately, I do not find any order disposing that application for vacating the order of ex parte hearing filed on behalf of the defendant.

Learned Civil Judge (Senior Division), 1st Court, Barasat is requested to dispose of the petition filed by the defendant with a prayer for vacating the order of ex parte hearing on the next available date.

With the aforesaid observation, the revisional application, being CO 714 of 2023, stands disposed of. Learned advocate appearing on behalf of the petitioners is at liberty to intimate the order to the learned Civil Judge (Senior Division), 1st Court, Barasat Calcutta, forthwith.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
