Md Faiyazuddin & ANR v. State Of West Bengal
17.02.2023 Serial no. 2 [G.S.D] Court No.35 CRR 381 of 2015 In re : An Application under Section 482 of the Code of Criminal Procedure.
-AndIn the matter of : Md. Faiyauzuddin & Anr. ... ... Petitioners Mr. N. P. Agarwala Mr. Pratick Bose ... for the State None appears for the petitioner at the time of second call.
Record reveals that since after 14th December, 2022, no one has appeared for the petitioner in this case, in spite of the case being pending in the list since months' together. Therefore, without wasting any further time, this case is taken up for disposal in absence of the petitioners as the same is a old one and pertains to the year 2015. In this case, the petitioners have prayed for quashing of the proceeding pending in the Court of Learned Chief Judicial Magistrate, Alipore arising in connection with Garden Reach, Police Station case no. 190/2014 dated 6.9.2014 under Section 188/283/34 of the IPC. The grounds pleaded by the petitioners to challenge the proceedings as above are not however found to be sufficient in order to warrant any interference by this Court in exercise of inherent extraordinary power under Section 482 of the Cr.P.C.
Hence, CRR 381 of 2015 along with connected application (s), if any, stand dismissed.
