Affidavit of service filed on behalf of the petitioner in Court today be kept with the record. The petitioner complains that the State is exploiting his land comprised in Dag No. 1109 under Khatian No. 1243 measuring about 1.43 acre under Mouza : Uddharanpur, District : Purba Bardhaman without acquiring the same in due process of law.

The grievance of the petitioner is that through his learned Advocate on February 08, 2019 he gave a representation to the District Magistrate & Collector, Purba Bardhaman being the respondent no. 6 herein with a prayer for acquiring the said land in accordance with law, but the said respondent has not disposed of the said representation till date.

The said respondent no. 6 is therefore directed to dispose of the said representation of the petitioner appearing at page 36 of the writ petition being Annexure P-7 in accordance with law by a reasoned order after giving the petitioner an opportunity of being heard within a period of twelve weeks from the date of communication of this order.

Since no affidavit-in-opposition has been invited the allegations made in the writ petition are deemed to have been denied by the respondents.

WPA 4271 of 2019 is thus disposed of. No order as to costs.
