Ananya Bandyopadhyay, J.:-

1. The instant criminal appeal is preferred by the petitioner being aggrieved and dissatisfied with an order and judgment dated 8.11.2000 passed by Learned Judicial Magistrate, 1st Class, 2nd Court, Midnapore, acquitted the accused persons in connection with C.R. Case No. 927 of 1994 under Section 248(1) of the Code of Criminal Procedure and discharged the accused persons from the said case.

2. Learned Advocate for the appellant submits that the appellant wants to withdraw the appeal and has submitted a written instruction from the appellant seeking permission to withdraw the instant criminal appeal. The prayer is allowed.

3. Accordingly, the instant criminal appeal is dismissed as withdrawn.

4. Lower court records along with a copy of this judgment be sent down at once to the Learned Trial Court for necessary action.

5. Photostat certified copy of this order, if applied for, be given to the parties on priority basis on compliance of all formalities. (Ananya Bandyopadhyay, J.)
