Perused the report filed by the Executive Officer, Namkhana Panchayat Samity. It appears there from that the authority accpeted the error on their part and has rectified the same by mentioning that the petitioner would be permitted to run the ferry till 31st May, 2024. In view of the aforesaid fair stand taken by the Panchayat Samity, nothing further is required to be adjudicated.

Learned advocate for the petitioner submits that there are certain issues with regard to the infrastructure facility provided by the Panchayat Samity for running the ferry service. Representations have been made before the Executive Officer of the Panchayat Samity but the same has not been taken up for consideration.

The instant writ petition is disposed of by directing the Executive Officer of the Panchayat Samity to consider the representations filed by the petitioner on 16th October, 2023 and 19th January, 2024 in accordance with law after giving reasonable opportunity of hearing to the petitioner at the earliest but positively within a period of two weeks from the date of communication of this order.

Necessary remedial steps shall be taken by the Executive Officer if the grievances of the petitioner appear to be genuine.

Learned advocate for the petitioner is directed to forward the copy of the representations dated 16th October, 2023 and 19th January, 2024 to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent certified copy of this order, if applied for, be supplied to the parties expeditiously, on compliance of usual legal formalities.
