1. Affidavit of service filed on behalf of the petitioner is taken on record.
2. Learned advocate representing the petitioner submits that she participated in 7th State Level Selection Test (Assistant Teacher) conducted by West Bengal Madrasah Service Commission (hereinafter referred to as Commission) and was selected for being appointed as Assistant Teacher.
As per requirement, petitioner is required to submit verification form for clearance to be issued by the police authorities. Petitioner submitted the verification form stating necessary details, but
inadvertently against a particular question "whether any criminal case is pending against the applicant in any Court of Law?" petitioner stated "no" instead of "yes". It is candidly submitted on behalf of the petitioner that a criminal case is pending against the petitioner and petitioner ought to have stated "yes"
against aforesaid question.
3. Prayer is made on behalf of petitioner which would permit her to submit fresh verification application before concerned police authorities.

Commission is represented by Mr. Pratik Dhar, learned senior advocate who submits, had the petitioner stated in the verification application for getting clearance from the concerned police authority that criminal case was pending against her instead of denying pendency of criminal case, in that event it would be within the domain of the concerned authority of said Commission to decide whether petitioner is eligible to be appointed in the post of Assistant Teacher considering gravity of offence.
5. State respondents are represented by Mr.
Rudranil De, learned advocate who submits that considering the filled in verification application submitted by petitioner
Director of Intelligence Bureau, Purba Bardhaman forwarded same to Intelligence Bureau, West Bengal, Kolkata.

As it appears from the submissions made on behalf of the petitioner and Commission that petitioner stood second in the competitive examination for being appointed as Assistant Teacher in a Madrasah and inadvertently stated in the verification application that no criminal case is pending against her, considering the possibility of appointment of the petitioner as Assistant Teacher on being selected in 7th State Level Selection Test (AT), 2023 and it is submitted on behalf of Commission that concerned authority of Commission would appraise taking note of the gravity of offence whether petitioner would be fit to be selected for appointment. Petitioner is directed to submit fresh verification application before the concerned police authorities by 7 (seven) days from date. Previous verification application submitted by the petitioner stands cancelled. If fresh verification application is submitted by the petitioner by 7 (seven) days, same shall be processed by the concerned police authorities by fortnight thereafter and necessary response to be forwarded to the
appropriate authority considering the contents of the new verification application.
7. However, it is made clear that if fresh verification application is not submitted by 7 (seven) days from date, previous verification application which was submitted by the petitioner shall stand revived and steps shall be taken based on said previous verification application.
8. With the aforesaid observations and directions writ petition stands disposed of.
9. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
