Atabuddin Molla @ Ataa ... Petitioner.
Adv. Siddhartha Sarkar, ... for the petitioner.
Adv. Joydeep Roy, Adv. Rituparna Saha, ... for the State.
The petitioner is in custody for more than a year and prays for bail.
Learned counsel for the petitioner submits that the petitioner's name has transpired from the statement of the coaccused and there is no other evidence against him connecting him to the murder.
Opposing the prayer, learned counsel for the State submits that the fire arms and ammunitions were recovered pursuant to the leading statement of the petitioner. The petitioner was found to have accompanied the victim and the co-accused immediately prior to the murder. CCTV footages show gait pattern of the petitioner and has been sent for forensic examination. Reports are awaited. Considering the material on record connecting the petitioner to the alleged offence, prayer for bail is rejected at this stage. The application for bail is disposed of.
