Mr. Sukanta Chakraborty Mr. Anindya Halder ...for the petitioner Mr. Pantu Deb Roy ...for the State Affidavit of service filed in Court today is taken on record.

The petitioner seeks consideration of his representation submitted before respondent nos. 5 and 7 on January 18, 2024 for waiver of tax, fitness fees, penalty etc. The said representation is yet to be considered. Learned counsel for the respondents submits that the representation comprises vehicles under control of the Regional Transport Officer, Tamluk, Purba Medinipur and the Regional Transport Officer, Paschim Medinipur and both the parties should be directed to deal with separate representations to be submitted by the petitioner. It appears from the representation submitted on January 18, 2024 that it covers 128 vehicles out of which 124 vehicles are within the jurisdiction of the 5th respondent and the remaining 4 vehicles are within the jurisdiction of the 7th respondent.

In view of the above, the writ petition is disposed of with liberty to the petitioner to submit two separate representations in this regard before the 5th and 7th respondents within a week from date. The 5th and 7th respondents are directed to consider and dispose of the representations submitted before them within two months from the date of receipt thereof upon affording reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law.

With the above observations and directions this writ petition is disposed of.

There shall however be no order as to costs.

Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
