Mr. Neguive Ahmed, learned counsel appearing for the State submits that a very large amount and a large number of people are involved.

The fact is that the petitioners are in custody for five

(5) years. We understand that the charge is to be framed by the learned court below today. We only expect that the trial be concluded within reasonable time. This is a fit case where the petitioners should be enlarged on bail.

Considering all the above circumstances, we direct the petitioners shall be released on bail upon furnishing a

bond of Rs. 10,000/- each with two sureties each of like amount, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Barasat, North 24 Parganas, subject to the condition that the petitioners will appear before the trial court on every date of hearing until further orders and will not intimidate the witnesses and/or tamper with evidence in any manner whatsoever. In the event the petitioners fail to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel their bail in accordance with law without further reference of this court.

We add a further condition that all details of the petitioners' work place and residence in Kolkata must be furnished by them with the Investigating Officer and that the petitioners will not travel to any other place other than Kolkata without informing the said Officer.

They will also not leave the country for any foreign destination without the permission of the Investigating Officer. They will deposit their passport with such Officer within seven days.
