15.03.2023 Ct. No. 29 CHC Rejected C.R.M.(A) 998 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Jamuria Police Station Case No.55 of 2023 dated 03.02.2023 under Sections 420/465/467/468/471/474 of the Indian Penal Code.

And In the matter of: Atul Gorai @ Atul Chandra Gorai ...... petitioner Mr. Kaushik Choudhury, Ms. Busra Khatun ....for the petitioner Mr. Shiladitya Banerjee ...for the State Apparently, the plot of land was initially transferred in the name of the petitioner. Thereafter, the petitioner transferred such land to his daughter. The initial transfer in favour of the petitioner is suspect. Investigation are in progress with regard to such transfer.

Prima facie case stands made out against the petitioner. Enlarging the petitioner at this stage on anticipatory bail is likely to affect the investigation.

In such circumstances, we are unable to grant anticipatory bail to the petitioner.

CRM (A) 998 of 2023 is rejected.
