Roy Chowdhury Ms. Biswadeepa Mandal ....for the Bank Authorities Mr. Subrata Guha Biswas ...for the State respondents 1) Learned advocate representing the petitioner submits that petitioner is a victim of cyber fraud and amount was debited from account of the petitioner on 6th August, 2025 in spite of requesting the concerned bank authority to freeze his account prior to such incident of fraud. Petitioner prays for necessary direction upon the concerned police authority to conclude the investigation and take necessary steps in connection with criminal prosecution initiated against the bank authority as well as persons who are involved in said incident of fraud.
2) State respondents and Bank authorities are represented by learned advocates.
3) Learned advocate representing the State respondents has placed a communication dated 15th March, 2026 of Inspector-in-Charge, Chapra Police
Station, Krishnagar Police District, Nadia along with supporting documents and same is taken on record. 4) It is disclosed in said communication dated 15th March, 2026 that on receipt of complaint on 26th September, 2025 a criminal prosecution being Chapra Police Station Case No. 1214 dated 26th September, 2025 was initiated under certain provisions of Bharatiya Nyaya Sanhita and investigation is going on. It is also disclosed that on investigation it was found that the amount was fraudulently transferred to multiple digital wallets and bank accounts, namely PayU, Cashfree, Amazon Pay, Indian Bank and Canara Bank.
5) In consideration of the steps taken by the police authorities as disclosed in the communication dated 15th March 2026, writ petition is disposed of and the police authorities are directed to take the investigation into logical conclusion expeditiously.
6) There shall be, however, no order as to costs.. 7) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
