Ms. Priyanka Sarkar ...for the Petitioner Mr. Arpit Chowdhury Mr. Suman Majumder ...for the O.P. no. 2 Being aggrieved and dissatisfied with the impugned proceeding being Complaint case no. 1375 of 2023 under Section 500/501 of the IPC, the petitioner has preferred the instant application with a prayer for quashment of the said proceeding. The allegation levelled in the petition of complaint was that the opposite party/husband as a counter-blast of petitioner's proceeding filed under the provision of Protection of Women from Domestic Violence Act, 2005, has preferred the instant complaint with some false and frivolous allegations.

However, due to intervention of the friends, relatives, wellwishers of both the parties as well as reputed persons in the society, the petitioner and the opposite party have settled their dispute and both of them want that the impugned proceeding shall be quashed because no fruitful purpose will be served by keeping the impugned proceeding alive.

Having heard learned counsel for both the parties, it appears that the dispute is purely private in nature and no public policy is involved in it.

In view of the compromise, the

complainant/opposite party has decided not to support the imputations levelled in the complaint and as such, continuance of further proceeding will be nothing but a wild goose chase that too at the cost of public exchequer. Furthermore, the offence is also compoundable in nature and in view of the amicable settlement by and between the parties, there is hardly any chance of conviction at the end of the trial.

Having considered the facts and circumstances of the case, CRR 1141 of 2025 along with CRAN 1 of 2025 stand allowed. The impugned proceeding being Complaint case no. 1375 of 2023 under Section 500/501 of the IPC, presently pending before the learned Judicial Magistrate, 6th Court, Alipore is hereby quashed.

Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
