Learned advocate for the petitioner submits that the petitioner is in custody for 136 days and has been implicated on the allegation of stalking and irritating the victim. Additionally, it has been submitted that charge sheet has been filed before the jurisdictional special court and petitioner may be released on bail on any stringent condition.

Learned advocate for the State opposes the prayer for bail and produces case diary.

I have taken into account the statement of the victim under Section 183 BNSS and having considered the same, I am of the opinion that further detention of the petitioner is unwarranted and he may be released on bail. 4.

Accordingly, the petitioner namely Sumit Chowdhury be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of like amount each, one of whom must be local to the satisfaction of the learned Judge, Special Court (POCSO), Howrah. If on bail, the petitioner shall be

physically present on each and every date of hearing before the jurisdictional court and shall not leave the district of Howrah without prior permission of the trial court. Additionally, the petitioner shall not enter into the jurisdiction of Liluah police station without prior permission of the learned Special Court. 5.

In the event he fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel his bail automatically without reference to this court. 6.

With the aforesaid observation, CRM (M) 634 of 2026 is allowed.
