1. Learned counsel appearing on behalf of the petitioner submits that the petitioner is only a friend of the lady with whom the petitioner was having a romantic relationship. He has been falsely implicated in this case. He is in no way connected with the alleged offence.
2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He relies on the post-mortem report and submits that it was case of death due to poisoning. He also refers to the statements of witnesses including the statement of the victim recorded in the hospital, which has been treated as a dying declaration. According to such declaration, the victim was forcibly married to his girl friend and there were some altercations between the families for which he allegedly committed suicide.
3. Considering the above, the other materials available in the case diary and the alleged role ascribed to the petitioner, I do not think that custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner.
4. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall cooperate with the investigation and shall not threaten or intimidate the witnesses. The petitioner shall meet the I.O once a fortnight till submission of report in final form.
5. Accordingly, the application for anticipatory bail is allowed.
6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
