The writ petition is filed for a direction upon the District Magistrate, Paschim Medinipur to comply with the direction of the Secretary, Government of West Bengal, Women & Child Development and Social Welfare Department dated May 14, 2014, which is Annexure P11 at pages 93 and 94 of the writ petition.
The Secretary came to the conclusion that the petitioners may be considered for supply of food materials to Pingla ICDS Project, if it fulfilled the stipulated criteria in this regard. The District Magistrate, Paschim Medinipur was directed to consider the eligibility of the petitioners in terms of the Memo dated March 26, 2014 issued by the concerned
department after conducting an inspection and as per the check list provided in the same memo.
The contention of the petitioners is that the District Magistrate, Paschim Medinipur upon receipt of the aforementioned order of the Secretary conducted a couple of enquiries through his office, but the ultimate proposal and/or decision was not communicated to the Secretary for final approval. It is further submitted that the enquiries conducted by the District Magistrate were in favour of the petitioners. The writ petition is disposed of with a direction upon the District Magistrate, Paschim Medinipur to take necessary steps in this regard. Upon completion of the enquiry and the verification of the eligibility criteria as per the check list and the Memorandum dated March 26, 2014, his opinion must be forwarded to the Secretary, Government of West Bengal, Women & Child Development for final approval.
The District Magistrate shall comply with this order within a period of six weeks from the date of communication. This Court has not expressed any opinion on the merits of the claim of the petitioners. A copy of the writ petition be served upon the authority along with a server copy of the order.
The writ petition is, thus, disposed of.
There shall be no order as to costs.
Parties are to act on the basis of the server copy of this order.
