The petitioner claims to be a self-help group whose name had been enrolled by the concerned department under the Ananda Dhara Scheme. The petitioner challenges the inaction of the District Magistrate, Purba Medinipur.
The writ petition is disposed of with a direction upon the District Magistrate, Purba Medinipur to intimate the petitioners as to whether the direction of the Secretary, Government of West Bengal, Department of Women & Child Development and Social Welfare Department contained in the reasoned order dated November 18, 2014, had been complied with or not.
The Secretary of the concerned department was of the view that the petitioner as a self-help group may be considered for supply of food materials
to ICDS projects in Purba Medinipur, if other criteria as laid down in the Memo dated March 26, 2014 along with the Check List were fulfilled by the petitioner.
According to the petitioner, although the Secretary, Government of West Bengal, Department of Women & Child Development and Social Welfare Department had passed the reasoned order, the necessary decision of the District Magistrate was not communicated either to the petitioner or to the Secretary of the concerned department. The District Magistrate, Purba Medinipur was also directed to forward his specific comments with regard to such prayer of the petitioner.
The writ petition is disposed of accordingly. The District Magistrate shall intimate the petitioner what steps were taken pursuant to the direction of the said authority, within eight weeks from the date of communication of this order.
This court has not taken into consideration the factual aspects as the District Magistrate is yet to give his/her comments on the eligibility of the petitioner in terms of the Memo dated March 26, 2014.
There will be no order as to costs.
All parties are to act on the basis of the server copy of this order.
